1Interpretation

InthisAct,unlessthecontraryintentionappears:

本法中，除非有相反之明示：

adoptedinrelationtoachild,meansadoptedunderthelawofanyplacerelatingtotheadoptionofchildren;

“收养为子女”指遵照任一地关于收养子女的法律来收养；

aircraftmeansamachineorapparatusthatcanderivesupportintheatmospherefromthereactionsoftheairorfrombuoyancy,butdoesnotincludeahovercraft;

“飞行器”指在大气层内能从空气的反作用中或从浮力中获得支撑的机械或装置，但不包括气垫船；

appointedairportmeansanairportappointedundersection10oftheCustomsAct[CAP];

“指定机场”指遵照《土著法》(CAP)第10条指定的机场；

appointedportmeansaportappointedundersection10oftheCustomsAct[CAP];

“指定港口”指遵照《土著法》(CAP)第10条指定的港口；

approvedformmeansaformapprovedbytheDirector;

“批准表格”指经局长批准的表格；

asylumclaimmeansaclaimforasyluminVanuatutoberecognisedasarefugee;

“庇护申请”指要求被视为难民而在瓦努阿图境内得到庇护的申请；

asylumclaimantmeansapersonwhomakesanasylumclaim;

“庇护申请者”指做出庇护申请之人；

charactertestmeansthecharactertestinsection38;

“品格测试”指本法第38条中的品格测试；

childincludesanadoptedchild;

“子女”包括被收养的子女；

citizenmeansacitizenoftheRepublicofVanuatu;

“公民”指瓦努阿图共和国公民；

customsofficerhasthesamemeaningasintheCustomsAct[CAP];

“土著官员”与《土著法》(CAP)中该词的含义相同；

dependentchildmeansachildofaperson,beingachildwhoisunmarriedand:

“依附性子女”指某人之未婚子女，且其：

(a)isunder18yearsofage;or

(a)未满18周岁；或

(b)is18,19or20yearsofageandisdependentonthepersonforfinancial,psychologicalorphysicalsupport;

(b)18-20周岁，并且在经济上，或心理上，或身体上依赖该人的支持；

DirectormeanstheDirectoroftheVanuatuImmigrationServices;

“局长”指瓦努阿图移民局局长；

exemptpersonhasthemeaninggivenbysection2;

“受豁免者”由本法第2条赋义；

extendedvisitorvisameansanextendedvisitorvisamentionedinsection29;

“展期旅游签证”指本法第29条中的获展期之旅游签证；

GovernmentmeanstheGovernmentofVanuatu;

“*府”指瓦努阿图*府；

holder,inrelationtoavisa,meansthepersontowhomthevisaisgranted;

“持有者”，就一份签证来说，指被授予该签证之人；

immigrationofficermeansaperson:

“移民官员”指：

(a)appointedasanimmigrationofficerundersubsection9(1);or

(a)遵照本法第9(1)条被任命为移民官员之人；或

(b)designatedtobeanimmigrationofficerundersubsection9(2);or

(b)遵照本法第9(2)条被指定为移民官员之人；或

(c)mentionedinsubsection96(2);

(c)本法第96(2)条所述之人；

memberofthefamilyofapersonmeans:

“某人的家庭成员”指：

(a)thepartneroftheperson;or

(a)该人伴侣；或

(b)anydependentchildoftheperson;or

(b)该人的任一依附性子女；或

(c)anotherpersonwho,intheopinionoftheDirector,shouldbetreatedforthepurposesofthisdefinitionasamemberoftheperson’sfamily;

(c)局长所认为的其他从本定义之目的出发应作为该人的家庭成员被对待之人；

MinistermeanstheMinisterresponsibleforimmigration;

“部长”指负责移民事务的内阁部长；

partner,inrelationtoaperson,means:

“伴侣”，就某人来说，指：

(a)ifthepersonislegallymarriedtoanotherperson,thatotherperson;or

(a)若该人与另外一人缔结合法婚姻，该另外之人；或

(b)ifthepersonisnotlegallymarriedtoanotherperson,butislivinginamarriagelikerelationshipwiththatotherperson,thatotherperson;

(b)若该人未与另外一人缔结合法婚姻，但与之在生活中维持事实婚姻关系，该另外之人；

policeofficermeansanofficeroftheVanuatuPoliceForce;

“警官”指瓦努阿图警察局官员；

premisesincludesanyplace,building,dwellingorstructure;

“场所”包括任一地方、建筑、住宅或结构体；

prescribedmeansprescribedbytheregulations;

“被规定”指被法规规定；

prohibitedimmigranthasthemeaninggivenbysection50;

“被禁止之移民”由本法第50条赋义；

proclaimedareahasthemeaninggivenbysection3;

“保留区”由本法第3条赋义；

refugeemeansapersondeterminedbytheDirectortobearefugeeunderPart9;

“难民”指局长遵照本法第9部分决定视其为难民之人；

regulationsmeanstheregulationsmadeunderthisAct;

“法规”指遵照本法制定的法规；

removalordermeansanorderfortheremovalofapersonfromVanuatumadeunderPart6;

“驱逐令”指遵照本法第6部分将某人驱逐出瓦努阿图国境之命令；

residencevisameansaresidencevisamentionedinsection30;

“居留签证”指本法第30条所述之居留签证；

securitymeansasecurityprovidedunderPart8;

“担保”指遵照本法第8部分提供的担保；

specialcategoryvisameansaspecialcategoryvisamentionedinsection32;

“特种签证”指本法第32条所述之特殊种类的签证；

studentvisameansastudentvisamentionedinsection31;

“学生签证”指本法第31条所述之学生签证；

subsequentasylumclaimmeansanasylumclaimmadebyapersoninVanuatuwhohaspreviouslymadeanasylumclaiminVanuatuthathasbeenfinallydetermined;

“接续庇护申请”指身在瓦努阿图境内且先前已在瓦努阿图境内提出过庇护申请且获批准之人提出的庇护申请；

transitvisameansatransitvisamentionedinsection33andprovidedforbyPart10;

“过境签证”指本法第33条所述并根据本法第10部分签发的签证；

traveldocumentmeansapassport,certificateofidentity,visa,permit,ticketorotherdocumentnecessaryforinternationaltravel;

“旅行证件”指护照、身份证明、签证、许可、交通票据或其他对国际旅行来说必要的证件；

terroristmeansapersonwho:

“恐怖分子”指：

(a)isamemberofaterroristgroupwithinthemeaningoftheCounterTerrorismandTransnationalOrganisedCrimeAct[CAP];or

(a)《反恐怖主义和跨国有组织犯罪法》(CAP)定义的恐怖集团的成员；或

(b)has
